Terms of Service

1. Acceptance of Terms

By accessing or using the BuildSalesFlow platform ("Service"), operated by Build Sales Flow Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

BuildSalesFlow provides a SaaS platform that enables businesses to create, deploy, and manage AI-powered sales agents. The Service includes brand cloning, knowledge base creation, lead capture, analytics, and optional voice call and messaging features depending on your subscription plan.

3. Subscription Plans and Payment

The Service is offered on a subscription basis. Current plans are:

• Starter (£99/month): 1 AI agent, 500 conversations/month
• Pro (£199/month): 5 AI agents, 2,000 conversations/month
• Voice (£299/month): Unlimited agents, unlimited conversations, AI voice calls

Payments are processed by Stripe. Subscriptions renew automatically each month unless cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Deceive, defraud, or mislead users of your AI agent
• Collect personal data without appropriate consent and legal basis
• Send unsolicited communications (spam) via the messaging features
• Attempt to reverse-engineer, hack, or disrupt the platform
• Resell or sublicense the Service without our written permission (except White-label plan holders)

5. Data and Privacy

You are the data controller for personal data collected by your AI agent from your website visitors. You are responsible for ensuring you have a lawful basis for collecting and processing this data, and for maintaining an appropriate Privacy Policy on your own website. BuildSalesFlow acts as a data processor on your behalf. Please review our Privacy Policy for full details.

6. Intellectual Property

You retain ownership of all content you upload to the platform (business information, documents, brand assets). You grant BuildSalesFlow a limited licence to process this content solely to provide the Service. BuildSalesFlow retains all rights to the platform, its code, and its AI models.

7. AI-Generated Content Disclaimer

Your AI agent generates responses using large language models. While we take steps to ground responses in your knowledge base, AI-generated content may occasionally be inaccurate. You are responsible for reviewing your agent's responses and ensuring they are accurate before deploying to customers. BuildSalesFlow is not liable for any harm caused by inaccurate AI-generated responses.

8. Limitation of Liability

To the maximum extent permitted by law, BuildSalesFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by third-party services (Stripe, Twilio, AI providers) or events outside our control.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time by cancelling your subscription and contacting support. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance.
